By creating an account or using Backseat Gamer ("the platform"), you agree to be bound by these Terms of Use. If you do not agree, you must not use the platform.
We may update these terms from time to time. We will provide at least 30 days' notice of material changes by posting the updated terms on this page and updating the "Last updated" date. If you do not agree with the revised terms, you may close your account before they take effect. Continued use of the platform after the notice period constitutes your acknowledgement of the revised terms.
You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement. We reserve the right to request verification of age at any time and to close accounts where this requirement is not met.
We reserve the right, at our sole discretion, to refuse registration, deny access to the platform, or decline to provide any part of the service to any person, for any lawful reason. We are not obligated to provide reasons for refusal except where required by applicable law.
When using Backseat Gamer, you agree not to:
Breach of this section constitutes a material breach of these Terms and may result in immediate account suspension or termination under Section 9.
Backseat Gamer provides tools for community organisers to manage communities and events. We are a platform provider, not an event organiser, venue operator, or participant. We do not control, endorse, or assume responsibility for the content, conduct, or outcomes of any community or event hosted on the platform.
Community organisers are solely responsible for managing their communities and events, including setting membership rules, event policies, and community guidelines. Organisers are independent users of the platform, not our employees, agents, or representatives.
When you RSVP to an event, you are making a commitment to attend. Repeated no-shows may affect your ability to RSVP to future events at the discretion of community organisers.
Some events may require payment for attendance. Payment processing is handled by third-party payment providers. The contract for event attendance is between you and the event organiser. Backseat Gamer facilitates the transaction but is not a party to it and is not responsible for disputes between attendees and organisers regarding payments, refund requests, or event quality.
Event tickets purchased through the platform are for leisure activities on a specific date. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (Regulation 28(1)(h)) and Article 16(l) of the EU Consumer Rights Directive, the 14-day cooling-off period does not apply to these purchases. By completing a ticket purchase, you acknowledge that the right of withdrawal does not apply.
Refund policies for event tickets are set by individual event organisers. Any voluntary refund policy offered by an organiser is at the organiser's discretion and does not create an obligation on the part of Backseat Gamer.
If your account is suspended or terminated as a result of your breach of these Terms, you are not entitled to a refund for any unused event tickets or platform services. This applies regardless of whether the breach is serious (such as harassment, threats, fraud, illegal activity, or conduct endangering the safety of others) or a lesser violation that has resulted in termination following prior warnings. The forfeiture reflects the costs incurred by us in investigating and responding to breaches, the impact on other users and organisers, and the need to maintain the safety and integrity of the platform.
We may, at our sole discretion and as a gesture of goodwill, choose to issue a partial refund in individual cases. Any such goodwill gesture does not create a precedent or entitlement for future cases.
Deliberately breaching these Terms in order to obtain a refund, chargeback, or other financial advantage constitutes fraud and will be treated as a material breach. We reserve the right to recover any costs arising from fraudulent chargeback claims, including administrative and payment processor fees.
Where your access to the platform is restricted as a result of your breach of these Terms, event organisers are under no obligation to issue refunds for event tickets you can no longer use. The contract for event attendance is between you and the organiser, and your inability to attend due to your own conduct does not create a refund obligation on the organiser or on Backseat Gamer.
You retain ownership of content you post on the platform. By posting content, you grant Backseat Gamer a non-exclusive, royalty-free, worldwide licence to display, distribute, and store that content solely as necessary for the operation of the platform. This licence ends when you delete the content or your account, except where the content has been shared with or relied upon by other users (for example, event descriptions or community posts).
Board game data displayed on the platform is sourced from BoardGameGeek and other third-party sources and remains the property of its respective owners.
You are solely responsible for ensuring that any content you post does not infringe the intellectual property rights of any third party.
We generally apply a graduated approach to enforcement, which may include warnings, temporary suspension, and permanent termination. However, we reserve the right to bypass earlier steps and immediately suspend or terminate your account where we reasonably consider it necessary, including for:
Where we suspend or terminate your account, we will notify you of the action taken and the reason for it within a reasonable timeframe (unless doing so would compromise an ongoing investigation or the safety of other users). You may contact us to request a review of the decision.
Upon termination, your right to access the platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 10, 11, 12, 13, and 14) will continue to apply. Termination does not affect your rights under our Privacy Policy or applicable data protection law.
You may delete your account at any time. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.
To the extent permitted by applicable law, the platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Without limiting the above, we do not warrant or represent that:
You acknowledge that your use of the platform and attendance at events listed on it is at your own risk.
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.
Subject to the above, to the maximum extent permitted by applicable law:
To the extent permitted by applicable law, you agree to indemnify and hold harmless Backseat Gamer and its operators from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) content you post on the platform; or (c) your conduct at events or within communities.
These Terms are governed by and construed in accordance with the laws of England and Wales.
If you are a consumer, you will benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law. Any dispute may be brought in the courts of England and Wales or, if you are a consumer resident in another jurisdiction, in the courts of your country of residence.
If you are a business, any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in the European Union, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that or any other provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Backseat Gamer regarding your use of the platform.
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, network or infrastructure failures, or third-party service outages.
